Terms and Conditions
This website is owned and operated by Kula Heart Yoga & Wellness, LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors yoga and body work services. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Kula Heart Yoga & Wellness, LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
The fee associated with a weekly/monthly subscription and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a weekly/monthly basis to your payment method. You may cancel this automatically renewing subscription in your membership account at any time. You may suspend the subscription and restart it at anytime from the membership page. There is no refunds for weekly/monthly subscriptions for any reason.
There is a minimum $10 handling fee for any refunds for any reason to cover service fees for class cards/bodywork services/classes/events. A different handling fee may be listed specifically in the terms of the service.
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.
You agree to indemnify and hold Kula Heart Yoga & Wellness, LLC owner harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
To the maximum extent permitted by applicable law, in no event shall [Kula Heart Yoga & Wellness, LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Kula Heart Yoga & Wellness, LLC owner, assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of United States/Pennsylvania, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Easton. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
CANCELLATION POLICIES
We understand that unanticipated events happen in everyone’s life. Space is limited and contractors are paid based on attendance.
Bodywork session, special event class, or workshop requires 24 hour notice. This allows the contracted bodywork therapist or instructor to fill their schedule promptly. If you are unable to give 24 hours advance notice you forfeit your deposit or session payment.
Yoga Class you may cancel or change your bookings up to 2 hours before the class starts. Otherwise you forfeit the class. Change your bookings in the members account page on our website and WIX APP.
Programs(including but not limited to courses, continuing education, training) may have different policies individualized by the independent contractor/instructor. Those policies are included at registration. At a minimum you must give one week notice if you can't attend the program. There is a $100 non-refundable fee. Less than one week notice you forfeit the fee of the program. If you miss classes within the training your certification for that program may be null and void.
No-shows
Anyone who either forgets or consciously chooses to forget their bodywork session, special event class, training yoga class or workshop for whatever reason will be considered a “no-show.” They will be charged 100% of the session/class or forfeit any refunds.
No-shows take away the opportunity to help a student or client. Please be considerate of all involved and give proper notice at 610-746-5852 and leave a message.
Late Arrivals
Bodywork session- The session may be shortened to accommodate the next appointment. Depending upon how late you arrive, we will determine if there is enough time remaining to start a treatment. Regardless of the length of the treatment actually given, you will be responsible for payment of the “full” session. Out of respect and consideration to the contracted massage therapist and other customers, please plan accordingly and be on time.
If you arrive late for a special event class, training or workshop. Admittance is up to the instructor. Disruption of a class or workshop could be detrimental to the flow or progress of the session. Please be considerate and be early.

CLASS CARD POLICY
Yoga Class Card Policy
Class cards are sold at a promotional rate and may have varying expiration dates.
Class Cards are subject to an Inactivity Fee = to One Class/month starting the month of expiration.
Kula Heart Yoga & Wellness, LLC. will charge an inactivity fee each calendar month the card remains inactive starting 30 days from the expiration date. If you then return to use the class card and classes remain, Kula Heart Yoga & Wellness, LLC will stop charging the inactivity fee. The inactivity fee will recommence after the next dormant 30 consecutive days.
Class Cards may not be used towards the purchase of Workshops, Series, or other Special Events unless noted otherwise.
Instructor's are contracted and may leave or discontinue offering the service you support. In these situations where you may no longer redeem the specific class card the balance of that class card may be used towards a different service offered at Kula Heart Yoga & Wellness, LLC.
PROMOTIONAL PACKAGE POLICY
Packages are discounted multiple sessions of the same length of service or varying services combined into a discounted package.
Examples of Packages: 6-One Hour Massages or 3-90 Minute Massage Sessions or 4- One Hour Private Yoga Lessons
Therapist's and Instructor's are contracted and may leave or discontinue offering the service for the package you have purchased at any time. In these situations where you may no longer redeem the specific package the balance of that package may be used towards a different service offered at Kula Heart Yoga & Wellness, LLC.
Promotional priced packages are subject to an Inactivity Fee = to $15/month. Kula Heart Yoga & Wellness, LLC, will charge an inactivity fee each calendar month the package is inactive starting 30 days from the expiration date or one year from purchase.
If you return after the inactivity fee has been started and a balance remains on your package you may use the remaining balance.
The inactivity fee will recommence after the next dormant 30 consecutive days.
